Testing During the Employment Process

Tests and other selection procedures can be effective at determining which applicants or employees are most qualified for a job. However, these tools can violate federal nondiscrimination laws if an employer uses them to discriminate based on race, color, sex, national origin, religion, disability, or age (40 or older). Use of tests and other selection procedures can also violate federal nondiscrimination laws if they disproportionately exclude people of a certain race, sex, or other protected class, unless the employer can justify the test or procedure under the law.
